UI Proposed Rules Changes

The Unemployment Insurance (UI) Division is proposing two Regulatory changes that will impact CO employers. Stakeholder outreach and engagement has begun prior to the anticipated enactment of the proposed legislation in 2027. Use the links provided to view the draft proposals.

  • Prohibition of Non-Charging (Pattern of Failing to Respond): The Division is responsible for establishing a process and procedure for an employer’s pattern of failing to respond, and for ensuring the Division's authority to implement its Prohibition of Non-Charging (PNC) process. Doing so will minimize costs associated with improper payments resulting from an employer’s failure to respond in a timely and adequate manner.
  • Reemployment Services and Eligibility Assessments (RESEA): The Division intends to create a policy that establishes clear RESEA requirements for UI claimants. This change will prevent RESEA participants from skirting current requirements and support CDLE’s reemployment initiatives.

Understanding Delayed Benefit Charges

Colorado Employers may see charges against their account during a period when a former employee(s) was not collecting unemployment insurance benefits. These delayed benefit charges are a result of a state law that limits the amount an employer experience rating can be charged in a given period (C.R.S. 8-76-102.5(11)(b)). 

State law limits the Division from charging more than one-third of the wages paid to an individual in a calendar quarter. Because of this limit, if a former employee’s total unemployment insurance benefit amount is more than the quarterly charging limit, the law requires the charges be spread out over subsequent quarters. This creates a rollover effect in the employer’s benefit charges:

  • During the claim period: The claimant receives benefits and the employer account is charged up to the quarterly limit allowed by law. 
  • Subsequent Quarters: Regardless if the claimant is no longer collecting benefits, the employer may see charges on subsequent quarterly statement(s).

Subsequent benefits charges do not represent new claims filed against the employer. These charges reflect benefits that were already paid in the past.

Fraud Reporting for Employers

When a claim is filed using the identity of one of your employees, you will receive a fact-finding request from the UI Division for information about the job separation. Employers can help the Division maintain the integrity of UI benefit payments by responding to Division requests in a timely manner, and reporting claims they suspect to be fraudulent.

Please submit an online fraud report to CDLE and contact UI Employer Services at (303) 318-9100 if you suspect your employer account has been compromised, you received a fact-finding request that may be fraudulent, or your account information has been updated without your consent.
